General Terms and Conditions (GTC) of TourismusRegion Baden AG

We are pleased that you are interested in the products of TourismusRegion Baden AG (hereinafter: TRB AG) and thank you for your trust. Please read the General Terms and Conditions (hereinafter: GTC) carefully. If you have any general questions or questions about our GTC, please contact us at info@deinbaden.ch.



1. General

The contract is concluded between the customer and TRB AG (Badstrasse 31, 5400 Baden). The GTC must be accepted by the customer at the time of order. By confirming the order, the customer agrees to the GTC. Any terms and conditions of the customer are expressly rejected.

2. Online Shop

2.1 Registration

When providing the personal information required for registration, the customer is responsible for ensuring its accuracy and completeness.

The customer must refrain from disrupting the website or using accessible data beyond the intended platform functionalities. Manipulations aimed at obtaining unauthorized payments or other benefits to the detriment of TRB AG may lead to legal consequences.

2.2 Order and Payment

Items offered on onlineshop.deinbaden.ch can be ordered securely, and payments can be made via credit card (Mastercard, Visa Card, Postcard), online banking with PostFinance Card E-Finance, or the online payment service TWINT.

2.3 Delivery Terms

The customer generally receives goods within five working days. In case of delays, the customer will be promptly informed. Delivery is made by post and is restricted to Switzerland and Liechtenstein.

2.4 Returns & Exchanges

Faulty or damaged items received by the customer must be returned to TRB AG within three working days of discovery. TRB AG will promptly send a replacement. Returns due to dislike are excluded.

2.5 Prices

Prices include VAT. Prices are subject to change but are binding at the time of order.

2.6 Shipping Costs

Shipping costs depend on the total amount in the shopping cart and include packaging fees.

2.7 Refusal of Acceptance

In the case of unjustified refusal to accept goods delivered by TRB AG, TRB AG will charge the incurred costs to the customer.

2.8 Retention of Title

Goods remain the property of TRB AG until fully paid.

2.9 Youth Protection

TRB AG does not sell alcohol to individuals under 18. By purchasing such products, the customer confirms being at least 18 years old and meeting legal requirements.


3. Private Guided Tours

3.1 Contract Formation

The contract between the customer and TRB AG is concluded upon acceptance of a telephone or written booking for a guided tour.

3.2 Execution

Guided tours are conducted in all weather conditions. Group size is limited to 25 people; groups of 26 or more will be split into two. An ideal group size is up to 20 participants.

3.3 Prices & Discounts

Current rates from the guided tour offerings apply. School classes (primary and vocational schools) receive a CHF 50.00 discount. Prices include VAT.

3.4 Vouchers

Vouchers must be submitted to the guide or at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden) on the day of the tour for redemption. Late or missing vouchers may render them invalid for the booked tour.

3.5 Surcharges

Custom tours and theme changes incur a surcharge of at least CHF 50.00 or are charged based on effort. Extensions of tours cost CHF 85.00 per started half-hour.

3.6 Rescheduling, Cancellation & Delay

One free rescheduling is allowed up to 8 days before the tour. Further rescheduling incurs a fee of CHF 40.00 per change. Rescheduling less than 8 days before the tour is considered a cancellation, subject to the following fees: Cancellation up to 8 days: CHF 80.00. / Cancellation 7–3 days prior: 50% of the price / Cancellation 2–0 days or no-show: 100% of the price. In case of delayed arrival, the tour may be shortened or additional time charged.

3.7 Payment

Invoices are sent to the customer after the tour. In exceptional cases, cash or credit card payments are accepted at Info Baden Tourist Office or directly with the guide.

3.8 Payment Default

Payment must be made within 30 days of the invoice date. Delays will incur reminder fees (CHF 10.00 for the second reminder, CHF 20.00 for the third). Outstanding amounts may be transferred to a collection agency.

3.9 Insurance

TRB AG is not liable for accidents during tours. Participants are responsible for their own insurance.


4. Public Guided Tours

4.1 Contract Formation

The contract is concluded with the purchase of a ticket, available on-site with the guide, online, or at Info Baden Tourist Office. Online purchases or those made at the Tourist Office require a booking confirmation as proof of purchase.

4.2 Execution

Public tours are held in all weather conditions. Group size is limited to 25 participants. Customers should arrive 10 minutes before the tour starts. Late arrivals cannot be accommodated.

4.3 Prices & Discounts

Current rates from public guided tours apply, including VAT. City Ticket holders receive free standard public tours (excluding special tours) but must pre-book at Info Baden Tourist Office or with the guide. City Tickets cannot be used for online purchases.

4.4 Vouchers

Tickets purchased with a voucher must be obtained in advance at Info Baden Tourist Office or on the day of the tour with the guide. Vouchers cannot be used for online purchases.

4.5 Payment

Online payments are accepted via credit card, PostFinance, or TWINT. At Info Baden Tourist Office, payment can be made in cash or by credit card. On-site, cash payment with the guide is accepted.

4.6 Returns & Exchanges

Tickets cannot be exchanged or returned.

4.7 Insurance

TRB AG is not liable for accidents during tours. Insurance is the responsibility of participants.

4.8 Personal Data

Customer data required for online ticket purchases is transmitted securely (SSL).

5. Mediation of Third-Party Services

(e.g., reservations for hotel rooms, conference rooms, and restaurant arrangements, as well as the sale of event tickets and vouchers)

5.1 Contract Formation

TRB AG acts solely as an intermediary and is not a contractual party in the provision of third-party services. TRB AG sells on behalf of and invoiced by the third-party provider. The respective terms and conditions of the third-party provider apply. The contract between the customer and the third party is established upon reservation or sale facilitated by TRB AG.

5.2 Liability & Complaints

TRB AG assumes no liability for third-party services mediated by them. Any complaints about the mediated service must be directed exclusively and promptly to the third-party provider.

5.3 Contract Terms

The purchase terms applicable to the mediated service provider are outlined individually for each inquiry or order and are binding for both contractual parties.


6. Miscellaneous Goods or Services

6.1 Contract Formation

The contract is concluded between the customer and TRB AG, including purchases at Info Baden Tourist Office.

6.2 Prices

Prices include VAT. Price changes are possible but binding at the time of order.

6.3 Payment

TRB AG
For services provided by TRB AG, an invoice will be sent promptly by post or electronically via email. The agreed-upon service will only be provided once full payment has been received.

Info Baden Tourist Office
For goods purchased at the Info Baden Tourist Office (Bahnhofplatz 1, 5400 Baden), payment is generally made directly in cash, by credit card (Mastercard, Visa Card, Postcard), or via the online payment service TWINT. In exceptional cases, TRB AG may allow payment on invoice. In such cases, the invoice will be sent promptly by post or electronically via email. Until full payment is received, the goods remain the property of TRB AG.

6.4 Payment Default

For invoice payments, the amount must be paid in full within 30 days of the invoice date. Failure to pay within 30 days results in the customer being in default. In such cases, TRB AG reserves the right to charge reminder fees in addition to the invoice amount. While no fees are charged for the first reminder/payment notice, fees for the second reminder are CHF 10.00, and for the third reminder CHF 20.00. Outstanding amounts (including interest and reminder fees) may be transferred or sold for collection purposes.

6.5 Returns & Exchanges of Goods from Info Baden Tourist Office

Defects must be reported immediately at the time of purchase. Otherwise, the goods are deemed to have been accepted as flawless by the customer. Returns due to dislike are excluded.

6.6 Youth Protection

TRB AG does not sell alcohol to persons under the age of 18. By purchasing such products, the customer confirms that they are at least 18 years old and meet the legal requirements.

7. Severability Clause

Should any clause of these GTC be invalid, this does not affect the validity of the other clauses. If any clause is partially invalid, the remaining portion remains valid. The parties agree to replace the invalid clause with an effective provision that comes as close as possible to the economic purpose of the invalid contractual condition.

8. Data Protection and Data Security

Ensuring secure transmission of personal data and optimal protection of customer privacy is a key concern for TRB AG. TRB AG complies with current data protection regulations. Further details can be found in the privacy policy.

9. Disclaimer of Liability

TRB AG is not liable for damages resulting from transmission errors, technical defects or malfunctions, operational failures, unlawful interference with IT systems of the user or third parties, damages caused by public systems and transmission networks, or damages due to interruptions (including system maintenance) or system overloads.

10. Governing Law

Swiss law applies to the entire legal relationship between TRB AG and the customer.

11. Jurisdiction

The exclusive place of jurisdiction is Baden, unless otherwise stipulated by the Swiss Civil Procedure Code.

12. Final Provisions

TRB AG reserves the right to amend the GTC. The version of the GTC published on the website at the time of the order/purchase is binding.
